Privacy Notice – How do we use your personal information?
Pacer welcomes the advent of the GDPR and is committed to respecting the data protection principles it sets out. We do collect and process personal data, but only for our own legitimate business interests, for the purposes of conducting and managing our business relationships with you, our customers and partners.
We only collect data that we need in order to conduct business negotiations, answer queries, provide technical support and keep you updated by email on the products, technologies and applications that are of interest to you. We believe that the ways in which we use your data could reasonably be expected by you in the business environment in which we operate. We retain your data for as long as we believe it to be accurate and relevant.
We have a legitimate interest in marketing our products to customers and prospects in order to increase sales. We have an interest in keeping our marketing communications useful and relevant to you, and we make every effort to do this by recording your areas of interest within our database.
You have the right to object to our processing of your data – if you do, please let us know. Please bear in mind that if you object to ANY processing by Pacer, this will affect our ability to conduct our business relationship with you. If you just want us to stop using your data for marketing purposes, please let us know and we will do so – this will only restrict our marketing communications.

You have the right to be informed about what data we hold about you, where we store it, and how we use it.
You have the right to ask us not to process your personal data for marketing purposes. You can exercise your right to prevent such processing by indicating your wishes at the time of contacting us, by unsubscribing from any newsletters we send you, or by contacting us at any time and by your preferred method of communication. We will still need to store your details on our system in order that we can record your wish NOT to be contacted ie to fulfil your right to erasure.
You have the right to access information held about you. You can ask us to supply you with copies of both paper and computer records and any related information (this is known as a subject access request), and we will provide this to you within 30 days at no charge.

INFORMATION WE MAY COLLECT FROM YOU AND HOW WE USE IT
Pacer International (“We”) need to store prospect and customer details in order to conduct our business – this is necessary in order to provide information to our customers and to carry out the required communications, quotations, negotiations and technical support which form part of a business relationship. We process this data in order to market our business to our contacts in a targeted, useful and relevant way, and in order to be able to record their preferences. As our storage and processing of data is relevant to our business relationships, we believe customers and contacts would reasonably expect this, and that there would not be an unwarranted impact on them.
The legal basis for our data processing would generally be:
EU GDPR Article 6 6(1)(f) – For the purposes of legitimate interest, as there is a relevant and appropriate relationship between the data subject (you) and the data controller (us).
We have conducted Legitimate Interests Assessments in line with GDPR guidelines, and we consider that generally, the purposes of legitimate interest best fit our circumstances.
As the business relationship with a contact progresses to a sales contract, our legal basis would also include:
EU GDPR Article 6 6(1)(b) – Processing is necessary for the performance of a contract with the data subject or to take steps to enter into a contract.
We would then store details of transactions you carry out with us, including the fulfilment of your orders, and would use the information to carry out our obligations arising from any contracts entered into between you and us.
We may collect and process the following data about you:
- Information that you provide by filling in forms on our websites (www.pacer.co.uk and www.pacer-usa.com). This includes information provided at the time of making an enquiry, registering to use our site, subscribing to our newsletter service, posting material, downloading documents or requesting further information or services.
- Information that you provide by sending us email, fax or any other written communication. This includes information provided at the time of making an enquiry or requesting further information or services.
- Information that you provide via telephone conversations or face to face meetings.

Your right to be forgotten

IP ADDRESSES, COOKIES AND IT RELATED DATA
We may collect and process the following data about you:
- Details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data, and the resources that you access.
- Information that you provide when you report a problem with our site.
We would then use this information to ensure that content from our site is presented in the most effective manner for you and for your computer, and to recognise you when you return to our site.
We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.

WHERE WE STORE YOUR PERSONAL DATA
All information you provide to us is stored on our secure company systems. We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 736 of the UK Companies Act 1985.
